TERMS AND CONDITIONS OF TRADE

Parties
This agreement is between LANDinfoNET Limited (“We”, “Our” or “Us”) and yourself (“You” or “Your”). Provision of our service is available to you upon reading and accepting the following terms of trade by clicking “I ACCEPT” at the base of these terms and conditions.

Services
We offer You the following services:
a.Searches of land title, documentation and plans through our licences with LINZ (Land Information New Zealand);
b.PPSR Searches on an individual, entity or motor vehicle through the Personal Property Securities Register;
c.Companies Office Database Searches;
d.Or any other information request we may undertake for you at anytime.

3Upon receiving Your request, We will use reasonable endeavours to provide the service within 2 hours (not including weekends, public holidays or outside normal business hours). This indicated timeframe is subject to the availability of our information sources to complete the services you require. You will not hold us liable should systems failure delay sourcing information on your behalf.

Payment - Casual users
Search or task requests will be completed upon receipt of monies. Credit Card Facilities are provided online at the time of ordering.

Payment - Account Holders
Invoices are supplied with each product or service. Payments can be made daily, weekly with maximum of the 20 th of the month following the presentation of the monthly statement. This is a strict and express term.

We reserve the right to charge Interest at 18% per annum for late payments i.e. after the 20 th of the month following the presentation of the monthly statement. In addition, You shall be liable for any collection costs We incur in collecting overdue payments,
including Our solicitor’s costs on a solicitor/client basis. The collection costs shall also bear interest at 18% per annum. Credit facilities may be withdrawn for any reason at Our discretion without notification.

All claims and requests for credit must be made within 7 days of invoicing. In each case the relevant invoice numbers must be quoted.

Limitation of Liability
Although We take all care, liability in tort or otherwise is limited to the cost of providing replacement services only, to the value of $100.00 . In particular and without limiting the generality of this clause, We and Our employees shall in no circumstances be liable for economic or consequential losses.

Waiver
No failure or delay by Us in exercising any right, power of privilege, and no course of dealing between You and Us shall operate as a waiver of any right, power or privilege.

Terms
These terms and any further terms set out by Us shall be included as terms in any agreement resulting between the parties and in the case of any conflict arising between these terms or the terms of the buyer’s order, then these terms and conditions shall prevail. We can vary these conditions at any time by publication on our website.

Orders
The request for any service shall for all purposes be deemed to be an acceptance of these conditions.

Privacy Policy
.We only collect information as requested and required by you. All information collected by Us or provided by You will be treated in accordance with the Privacy Act.

Direct Publications
We from time to time issue Newsletters and Newsflashes with relevant news regarding the land transfer process, Personal Property Security Register and related topics, by post and e-mail. These news publications are an additional service at no cost to You. Should you not want to receive these publications please notify Us by email [email protected].

Accurate and Current Information
We undertake every endeavour to ensure the services we provide are accurate and current in accordance with your instructions. There is no implied warranty or guarantee of the accuracy and currency from any of Our source providers. We shall not be held liable due to any in accuracies held on public databases or from any of our information sources.

Copyright/Intellectual Property
The materials contained within this website including but not limited to, content, logo’s, trade names, artwork, system source code, system software, visual effects and elements all remain ownership of LANDinfoNET Limited. No duplication of any such material can be done without the express approval of LANDinfoNET Limited.
